  1. General
    1. This policy on the processing of personal data ("Privacy Policy") describes how Home-tex.com ("HOME-TEX", "us", "our", "we") collects and processes information about you.
    2. The Privacy Policy applies to personal data that you provide to us, or that we collect via HOME-TEX's website, www.HOME-TEX.com ("the Website").
    3. HOME-TEX is the data controller for your personal data. All inquiries to HOME-TEX can be made via the contact information listed under section 7.
  2. Which personal data do we collect and whats the purpose as well as the legal basis for processing
    1. When you visit the Website, we automatically collect information about you and your use of the Website, such as the type of browser you use, the search terms you use on the Website, your IP address, including your network location, and information about your computer.
      1. The purpose is to optimise the user experience and the website's functionality, as well as to conduct targeted marketing, including retargeting via Facebook and Google. This processing of information is necessary to safeguard our interests in improving the Website and showing you relevant offers.
      2. The legal basis for the processing is the EU General Data Protection Regulation, art. 6, subsection 1, letter f.
    2. When you buy a product or communicate with us on the Website, we collect the information you provide, such as name, address, e-mail address, phone number, payment method, details of the products you purchase and possibly return, delivery requests, as well as the IP address from which the order was made.
      1. The purpose is to deliver the products you have ordered and fulfil our agreement with you, including managing your rights to return and make complaints. We may also process information about your purchases to comply with legal requirements, including for bookkeeping and accounting. When making a purchase, the IP address is collected to safeguard our interest in preventing fraud.
      2. The legal basis for the processing is the EU General Data Protection Regulation, art. 6, subsection 1, letters b, c, and f.
    3. When you sign up for our newsletter, we collect information such as your name, email address, and possibly your mobile number.

  3. Recipients of Personal Data
    1. Your name, address, email, telephone number, order number, and specific delivery instructions will be shared with GLS, Bring, or a courier responsible for delivering your purchased items. For non-stock items, these details can be passed on to the manufacturer or seller, who will then handle the delivery.
    2. Information may be disclosed to external partners who process it on our behalf. We use external partners for a variety of purposes, such as the technical operation and improvement of the website, sending newsletters, targeted marketing including retargeting, and for soliciting your feedback on our company and products. For instance, we share your name and email with TrustPilot so they can send you an invitation to rate us on their site. If you choose to leave a review, TrustPilot becomes the data controller for the provided information. These companies are data processors acting under our instructions, processing data for which we are responsible. Data processors are only authorised to use your information to fulfil our agreement and must keep it confidential. We have signed written agreements with all data processors who handle personal data on our behalf.
    3. Two of these data processors, Google Analytics by Google LLC and Facebook Inc., are based in the United States. The necessary guarantees for transferring information to the USA are secured through the data processor's certification under the EU-US Privacy Shield, pursuant to the EU General Data Protection Regulation, Article 45.

  4. Your rights
    1. To ensure transparency in how we process your information, we, as the data controller, need to inform you about your rights.
    2. Right of access
      1. You have the right to request information from us at any time about what information we have registered about you, the purpose of the registration, the categories of personal data and recipients of the information, as well as where the information originates.
      2. You are entitled to receive a copy of the personal data we process about you. If you would like a copy of your personal data, please send a written request to Peter@home-tex.com. You might be asked to verify your identity.
    3. Right to rectification
      1. You have the right to have incorrect personal data about yourself corrected. If you notice any errors in the information we have registered about you, please contact us in writing so we can correct the information.
      2. You can correct the information we have collected in connection with your registration to our customer club by logging into your user profile.
    4. Right to erasure
      1. In certain instances, you have the right to have all or some of your personal data deleted by us, for example, if you withdraw your consent and we have no other legal basis to continue processing your data. If the continued processing of your information is necessary, for example, for us to comply with our legal obligations or for legal claims to be established, asserted or defended, we are not required to delete your personal data.
    5. Right to limit processing to storage
      1. In certain cases, you have the right to restrict the processing of your personal data to storage only, for example, if you believe that the information we process about you is incorrect.
    6. The right to data portability
      1. In certain cases, you have the right to receive the personal data you have provided to us in a structured, commonly used, and machine-readable format, and you have the right to transfer this data to another data controller.
    7. The right to object
      1. You have the right to object to our processing of your personal data at any time for direct marketing purposes, including profiling carried out to target our direct marketing.
      2. For reasons relating to your personal situation, you also have the right to object at any time to the processing of your personal data that we carry out based on our legitimate interests, cf. pt. 2.1 and 2.3.
    8. The right to withdraw consent
      1. You have the right to withdraw any consent you have given us for the processing of personal data at any time, including for profiling carried out as a member of the customer club. If you wish to withdraw your consent, please contact us at Peter@home-tex.com.
    9. The right to complain
      1. You have the right to lodge a complaint at any time with the Data Protection Authority, Borgergade 28, 5, 1300 København K, about our processing of your personal data. Complaints can be submitted by email to dt@datatilsynet.dk or by telephone at +45 33 19 32 00.
  5. Deletion of personal data
    1. Information collected about your use of the Website cf. pt. 2.1. will be deleted at the latest when you have not used the Website for one year.
    2. Information collected in connection with your registration for our newsletter will be deleted once you withdraw your consent, unless we have another legal basis for processing the information.
    3. Information collected in connection with purchases you have made on the Website, see section 2.2, will generally be deleted 3 years after the end of the calendar year in which you made your purchase. However, information can be stored for a longer period if we have a legitimate need for extended storage, such as if it's necessary for legal claims to be established, asserted, or defended, or if storage is required to meet legal obligations. Accounting material is stored for 5 years until the end of a financial year to comply with the Accounting Act requirements.
    4. Information collected during your registration and membership with our customer club, see section 2.4, will be automatically deleted: a) if you have not logged into your user profile for 3 years, b) if you deactivate your customer club membership and do not reactivate it within the next 3 years, or c) if you unsubscribe from your customer club membership.
  6. Security
    1. We have implemented appropriate technical and organisational security measures to prevent personal data from being accidentally or unlawfully destroyed, lost, altered, or degraded, as well as to protect against unauthorized access or misuse.
    2. Only employees who need to access your personal data to perform their work are granted access.
